Eminent domain practitioners from multiple states will discuss the various statements made about eminent domain in the hit show Yellowstone, and explain which statements are grounded in reality and which ones just make for good TV. This session addresses the general concept of eminent domain and hit on some state-specific issues from the show under multiple state laws including Montana, Wyoming, Nebraska, Colorado, Missouri, Kansas, and Arizona.

The Need for Zeal in the Practice of Law, and the Upper and Lower Limits of that Zeal, with Numerous Case Examples

The Rules of Professional Conduct (and basic professional rectitude) require that attorneys represent their clients with “reasonable diligence and promptness.” Overlaying that requirement is the duty to represent each client with “zeal.”  However, too many lawyers fail to pursue each representation with that degree of commitment, to their client’s harm, while too many (other) lawyers take the mantle of zeal to the opposite extreme to the extent of overzealousness. This program explores the legal duty imposed on each lawyer to represent each client zealously while examining the upper and lower extremes of this duty as evidenced by real case examples.
