Our attorneys work with national, regional, and community banks and agricultural lending cooperatives to finance projects nationwide, including dairy, cattle, and swine facilities; cattle, pig, sheep, and buffalo operations; public warehouses and grain storage facilities; and cropland and rangelands. Our experience includes documenting, administering, servicing, restructuring, and collecting agricultural loans, including syndicated loans, as well as securitizing domestic and international commodity transactions through letters of credit and other credit enhancement devices. We frequently service large pools of agricultural loans as well as specific livestock, crop, and land loans.
Spencer Fane litigates, mediates, and resolves lien priority disputes, commercial disputes, and cattle frauds throughout the United States. Our attorneys have acted as lead counsel for the primary creditor in more than 200 receiverships and have worked under court authority to administer and sell livestock and agricultural commodities throughout the United States. We work with the United States Department of Agriculture and the Justice Department on livestock export and import issues and practice in Commodity Futures Trading Commission litigation. Our attorneys regularly practice under the Packers and Stockyards Act, the Perishable Agricultural Commodities Act, the Uniform Commercial Code, and state branding laws.
On behalf of livestock producers and packers, we have prepared and enforced supply agreements. When relevant, we have the breadth of experience in other practices to help clients in matters involving business transactions, environmental, real estate, energy, intellectual property, and litigation.
