“At minimum, taxpayers need to contractually ensure the project is FEOC compliant and adheres to Notice 2026-15, and conduct a proportional amount of due diligence. Absent fraud on the part of the taxpayer, it will be difficult for the IRS to challenge a taxpayer’s use of the credit (in an audit) if the taxpayer is able to provide records showing reasonable due diligence,” Bill wrote.
