Overview

Patrick Mosley represents a diverse base of clients in a wide range of matters pertaining to bankruptcy and creditors’ rights and corporate reorganizations and restructurings. With a deep understanding of respective industry risks, opportunities, and overall positioning, he cuts through complexities to develop detailed strategies for favorable results in and out of the courtroom.

Specifically, Patrick represents distressed companies, unsecured creditors’ committees, and purchasers of assets in all aspects of complex bankruptcies and insolvency proceedings, and secured and unsecured creditors in workouts, non-bankruptcy corporate reorganizations, and acquisitions of troubled businesses. In addition, he provides businesses with general corporate advice for efficient, scalable operations and assists with mergers and acquisitions, institutional lending, real property purchase and sale transactions, and commercial development.

Prior to entering private practice, Patrick gained valuable legal experience in U.S. bankruptcy courts, serving as a law clerk to the Honorable Colleen A. Brown, U.S. Judge for the District of Vermont, and the Honorable Catherine Peek McEwen, U.S. Bankruptcy Judge for the Middle District of Florida.

  • Represented a developer and owner of an oil refinery in prosecution and indemnification of claims related to a general contractor bankruptcy filing.
  • Represented a purchaser of a retail business with over 50 locations at bankruptcy sale.
  • Represented a floorplan lender in replevin and recovery of collateral consisting of boats from a boat dealership with multiple locations.
  • Assisted a private college with winddown of operations and dissolution, including the liquidation of all assets, settlement of claims, teach-out plan, and creation of a foundation.
  • Represented a secured creditor in a contested confirmation trial of financial services business, resulting in denial of confirmation and conversion of case to Chapter 7.
  • Represented landlords in Chapter 11 cases of national retail chains resulting in assumption of leases, rejection of others, and negotiated cure payments.
  • Assisted a tier 2 automotive supplier with workout and settlement of secured claims and sale of business.
  • Represented a member of a Chapter 11 debtor with sale of membership interest of the debtor’s primary asset, an entertainment venue.
  • Assisted a medical device manufacturer with workout and settlement of secured debt exceeding $35 million and sale of business.
  • Represented a creditors committee in Chapter 11 bankruptcy proceeding of oceanfront retail development.
  • Represented secured lenders in commercial foreclosure actions of golf courses, college campuses, CDD developments, office towers, retail centers, and other various commercial properties.
