Overview

Casey Malloy represents clients in commercial litigation matters in state courts, federal courts, and arbitration at the trial and appellate levels. Casey’s clients appreciate his ability to solve problems, practical approach to litigation, and experience in the courtroom.

Casey’s litigation experience includes contract disputes, construction disputes, government investigations, health care disputes, and intellectual property matters. His clients include employers seeking to enforce non-solicitation and non-compete agreements, construction companies defending claims related to various projects, and health care companies facing challenges with billing practices.

Prior to attending law school, Casey served in the U.S. Army as an Armor Officer, where he led a scout platoon on NATO training exercises in Eastern Europe and was the Distinguished Honor Graduate of the Army Reconnaissance Course. He has worked pro bono on behalf of servicemembers and veterans and, in 2022, notably earned the American Bar Association Military Pro Bono Project Outstanding Services Award.

  • Represents construction companies, property owners, suppliers, and developers in disputes related to payment for projects, lien issues, and issues related to defective supplies or workmanship.
  • Represents health care companies in disputes related to claims payment, billing code practices, and managed care.
  • Represents property owners in commercial lease disputes with long-term tenants and negotiates commercial lease terms for clients seeking new landlord or tenant partnerships.
  • Obtained a temporary restraining order preventing former employees of a financial institution from soliciting customers.
  • Obtained a temporary injunction prohibiting the transfer of disputed assets across state lines until the resolution of litigation.
  • Obtained a favorable arbitration award on behalf of a manufactured housing company for claims arising from the sale and installation of a prefabricated home.
  • Obtained an order granting summary judgment and dismissal of contract and tort claims in the U.S. District Court for the Eastern District of Tennessee that was later affirmed by the U.S. Court of Appeals for the Sixth Circuit.
  • Obtained an order granting summary judgment and dismissal of contract and employment-related claims in the Chancery Court for Williamson County, Tennessee.
  • Obtained a writ of certiorari from the Tennessee Supreme Court for review of a Tennessee Court of Appeals ruling on issues related to piercing the corporate veil of multiple business entities.
  • Provided pro bono representation to a military servicemember that resulted in the prompt entry of judgment against an adverse party and eventual favorable resolution of the dispute.
