Spencer Fane attorney Shannon M. Bond wrote the article Information Blocking Enforcement on the Horizon, which was recently published by Health IT Answers.
In Shannon’s article, which originated as a firm blog post, she discusses the growing focus on enforcement of information blocking regulations in the health care industry. She notes that while the rules are not new, regulatory scrutiny and investigative activity are increasing. Shannon encourages organizations to take proactive steps to ensure compliance as enforcement efforts ramp up.
“While the information blocking rules have been in place for years, there has been no public information regarding information blocking investigations or enforcement actions (though Keane claims there have been no enforcement actions to date). Now, however, with the current administration’s emphasis on and funding of information blocking investigations and enforcement, health IT entities and health care providers should reevaluate their policies and procedures on information blocking,” Shannon wrote.
Shannon is a member of the Spencer Fane Health Care group. She focuses her practice on regulatory, transactional, and business issues impacting health care clients, working primarily with health care providers to find solutions related to internal governance, regulatory compliance, contract structuring, and other issues that they might encounter.
