The piece originated as a firm blog post and explores the impact of the New Mexico Court of Appeals case, State of New Mexico ex rel. Bigney v. City of Rio Rancho. Jacob outlined the case’s facts, procedural history, court analysis, and implications. The January 16 opinion, he explains, “suggests that public nuisance law can be a powerful means of enforcing environmental law and land use restrictions where government authorities repeatedly fail to enforce permitting requirements.”
