John Watson Explores Ongoing Legal Battle over Vehicle Emission Standards in Law360

August 7, 2025

Law360 recently published Spencer Fane attorney John Watson’s article on the contentious California vehicle air emission regulations that continue facing challenges in court and Congress.

John’s piece – Calif. Air Waivers Fight Fuels Automakers’, States’ Uncertainty – outlines the emission standards at issue and what challenges they face, explains their uniqueness, and discusses the impact to vehicle manufacturers, California and 17 additional states. He notes that a resolution will be years in coming, making it difficult for states and stakeholders to plan.

“With the Supreme Court’s ruling in favor of standing for the fuel producers, we await other court decisions on this matter, which will undoubtedly end up before the high court again,” John said.

“Not all vehicle manufacturers are of one mind. Some oppose the waivers, while others support them. But the status of the waivers greatly complicates their business plans. And what will the states do? They will have to await the judicial resolution of the issues. The courts’ resolutions will determine how the state and federal governments and the vehicle manufacturers work together to implement vehicle air emissions standards nationwide.”

At the firm, John is a distinguished voice in environmental and energy law who leverages his in-depth commercial trial and litigation knowledge to understand clients’ needs and goals and serves as a formidable advocate on their behalf.
