James Korte Talks Future of Colorado Non-Compete Agreements in ColoradoBiz Magazine

Spencer Fane attorney James Korte recently discussed the Federal Trade Commission (FTC’s) proposed rule that will effectively ban the use of non-compete agreements in ColoradoBiz Magazine.

In his article, How Will FTC’s Proposed Ban on Non-Compete Clauses Impact Colorado Law?, James summarizes the FTC’s proposed rule, notes its place in the adoption process, and discusses its potential effect on Colorado’s existing laws regarding restrictive employment covenants.

“Essentially, the FTC is proposing that its ban on non-compete clauses would set the ‘floor’ for state regulation,” James said. “Meaning states can enforce laws that provide greater protections than provided by the proposed rule.”
