Jacob Hollars Examines Significance of Colorado Supreme Court Eviction Case in Dual Publications

Spencer Fane attorney Jacob Hollars authored articles recently published in both Law Week Colorado and Law360 about the potential impact of the Claire Miller v. Jesse Amos case.

The articles originally appeared as a firm blog post, which summarizes the Colorado Supreme Court’s review of Miller, which will determine if the Colorado Fair Housing Act can be utilized as an affirmative defense against eviction. Jacob also explains why the case’s outcome could “drastically change [the] respective rights and obligations” of Colorado landlords and tenants.

“Most notably, the assertion of such a defense could dramatically prolong the eviction process,” he noted in both publications. “As discovery into the alleged discrimination and retaliation would likely become necessary prior to proceeding to a hearing on possession.”
