Spencer Fane attorney Andy Lester recently wrote an article for the American Bar Association about an Oklahoma Supreme Court decision and its potential impact on future public nuisance litigation.
Titled “Oklahoma Curbs Public Nuisance Expansion,” Andy describes the Oklahoma Supreme Court’s reversal of a $465 million district court verdict in State ex rel. Hunter v. Johnson & Johnson.
“The Oklahoma ruling is a significant step toward retaining traditional notions of public nuisance law and moving away from expanding the claim to include mass torts litigation,” Andy explains in the article.
