Paul Jacobson Highlights Key Proposition 65 Compliance Changes in Corporate Compliance Insights

June 3, 2026

Spencer Fane attorney Paul Jacobson wrote the article Changes Coming to California Prop. 65 Warnings, which was recently published by Corporate Compliance Insights.

In Paul’s article, which originated as a firm blog post, he explains the upcoming changes to California’s Proposition 65 warning requirements and the broad impact they may have on businesses nationwide. He discusses the key compliance and strategic considerations companies should evaluate as they prepare for the new rules taking effect in 2028. Paul also highlights the importance of early planning to address labeling, enforcement, and risk management concerns.

“This compliance date implicates questions of risk tolerance and how to establish manufacture and label date to ward off enforcement. Meeting the January 2028 date will require significant work in advance to select and implement appropriate warnings, properly notify downstream distributors and retailers, and prepare for the next wave of Prop. 65 enforcement,” Paul wrote.

At Spencer Fane, Paul guides clients through their environmental and workplace safety challenges involving EPA, OSHA, state environmental and workplace safety agencies, and private parties. Paul helps manufacturing, mining, and energy companies understand and manage federal and state requirements in RCRA, the Clean Air Act and Clean Water Act, CERCLA, National Environmental Policy Act, and state corollaries. He responds to agency investigations, information requests, and enforcement, with notable experience in RCRA defense, including RCRA’s air emissions standards.
