Shawn Tuma Weighs in on Indiana Data Privacy Bill in The Journal Gazette

Spencer Fane attorney Shawn Tuma recently discussed Indiana State Senator Liz Brown’s latest data privacy bill with The Journal Gazette reporter Brett Stover.

In the article, Sen. Brown’s Bill Would Make Indiana 6th State with Data Privacy Law, Shawn compared the Indiana law proposal, Senate Bill 5 (SB 5), to other existing privacy regulations such as the European General Data Protection Regulation (GDPR), California’s Consumer Privacy Act, and the Virginia Consumer Data Protection Act. He also opined on the impact such policies have on both businesses and consumers.

Noting that the GDPR and California law are both quite broad, Shawn said that the Virginia model and SB 5 are “much more reasonable” for businesses due to how they define personal data. “[SB 5] defines personal data … as information that is linked or reasonably linkable to an identified or identifiable individual,” he said. “So it requires at least a connection that you can kind of see.”
