John Watson Outlines CEQ’s New Guidelines for NEPA Reviews in POWER Magazine

Spencer Fane attorney John Watson recently authored an article published in POWER Magazine: CEQ’s New Guidance on NEPA Reviews for Clean Energy Projects.

John outlines the Council on Environmental Quality (CEQ)’s revised guidance for conducting National Environmental Policy Act (NEPA) reviews for clean energy projects. He identifies how the new document replaces parts of its 2016 predecessor, stating:

“The CEQ guidance has enjoyed a tortured history of variations from administration to administration.  But for the foreseeable future, this guidance forces proponents to consider a broader range of ‘reasonable’ alternatives and emphasizes the ‘social costs’ of a project and its cumulative impacts.”
