A Spencer Fane team, led by attorney Aaron Dean, recently helped a client successfully obtain contract award involving a $6.4 million public construction contract for a highway road reconstruction and utility installation project.
The firm’s client, a road, underground utility, and demolition contractor in Minnesota, was the low bidder on a $6.4 million public road reconstruction and utility installation project, and the second low bidder protested award to the firm’s client.
More specifically, the local county’s board of commissioners initially voted to award the contract to the second low bidder, but the county later rescinded the preliminary decision and postponed a final decision. In response, the Spencer Fane legal team submitted comprehensive Bid Award Letters to the county commissioners, county attorney, and other county officials advocating for its client to receive contract award and appeared before the county commissioners. In turn, after a series of open meetings and presentations to the county commissioners, the county returned a unanimous 5-0 vote in favor of awarding the contract to the firm’s client. Aaron now leads the defense of the contract award in litigation commenced by the second low bidder.
