December 13, 2024

The Phoenician Scottsdale | 6000 E Camelback Rd, Scottsdale, AZ 85251

Spencer Fane attorneys Richard Holley and Ian Rubenstrunk will join panels at the American Bankruptcy Institute (ABI) Winter Leadership Conference, a December 12-14 event in Scottsdale, Arizona.

This annual ABI program provides a slate of valuable sessions for consumer and business practitioners and financial advisors. The conference also offers numerous social and fun events to network and renew friendships with colleagues from around the nation and overseas.

On December 13, Richard will lend his thought leadership to the panel, Chapter 11 vs. Out-of-Court Restructuring: Predictions and Strategies. This session will delve into expected restructuring trends such as the 70-75% out-of-court restructurings expected to comprise the next year and a half’s workout “transactions.”

Next, Ian will moderate the Remote Control: Not Just for Toys Anymore panel, which will discuss various issues arising from a new class of collateral: that which is remotely controllable through technology such as robotics and artificial intelligence. The panelists will address an array of topics and unanswered questions about how the law is (or is not) suited to address new issues regarding the use, regulation, and pledging of such assets. Topics will include the risks for creditor and borrower and the role of the government in finding efficient solutions to potentially unforeseen issues.

At Spencer Fane, Richard Holley helps clients throughout Nevada and elsewhere in the U.S. with difficult bankruptcy and related commercial litigation matters. His primary focus is bringing value to the clients he serves through open communication, collaboration, and transparency while reducing frustrations. Ian assists a wide array of clients including banks, credit unions, nontraditional lenders, private equity, equipment financers, receivers, landlords, and asset buyers in financial services matters, focusing on all sides of distressed transactions and turnaround matters.
