Michelle Berger Obtains Favorable Outcome for Land Use Client

Spencer Fane attorney Michelle Berger worked on behalf of a construction/mining client to obtain a favorable result after a hearing before the Colorado Mined Land Reclamation Board (MLRB). Relying on a detail-oriented, analytic approach to navigating similar matters, she achieved the outcome to allow the business to move forward with its mining plans in Colorado.

Michelle assisted the client with obtaining a mining permit (112 Construction Materials Reclamation Permit Amendment) over 14 objections that were presented to the MLRB in a prehearing order. The resulting permit also approves the use and installation of a conveyor on the client’s mining site, which allows them to complete the project in a more environmentally friendly and sustainable manner.

In addition to helping clients with these niche matters, Michelle also assists in all aspects of engineering and construction law, including bridging the gap between concept and project completion; handling contract drafting and negotiation; navigating mechanic’s liens; leading traditional and alternative dispute resolution processes; resolving employment and contract disputes; and, establishing and monitoring risk management and insurance protocols.
