Spencer Fane attorney Jeremy Moseley was a guest on a recent episode of the Emerging Litigation Podcast to discuss the evolving, complex world of insurance litigation.
In his conversation with host Tom Hagy, Jeremy explained how automation, AI, and climate change present new risks for claims lawsuits. He also touched on social inflation, the increase in nuclear verdicts (excessively large jury awards), and defense strategies for insurers.
And so what about the proactive steps, beyond litigation, that insurers can take to address the trend of these nuclear verdicts?
“I would say there are three things that insurers can look at [to address the nuclear verdict trend],” Jeremy said. “The first and foremost is tort reform in the legislatures. Obviously, these outlandish verdicts don’t help consumers. They raise the premiums for everyone and the way to get control of those is tort reform … The second, I would say, is risk management, both internally and with corporate insurers for their liability claims, having a greater focus on safety programs.”
