Eric Van Horn Addresses the ‘Texas Two-Step’ in Bankruptcy Roundtable Discussions

Spencer Fane attorney Eric Van Horn recently presented during a networking event for bankruptcy attorneys hosted by Ravinia Capital LLC and Saul Ewing Arnstein & Lehr LLP.

During the two roundtable sessions, “Impact of Purdue Pharma’s Chapter 11” and “2022 Outlook for Bankruptcy Filings,” Eric co-presented with Professor Ralph Brubaker (University of Illinois College of Law) and Doug Smith (Aurelius Law Group LLC). The panel covered the impact of the Purdue Pharma LP Chapter 11 case, potential reasons bankruptcy filings remained low during the pandemic, and possible predictions for the bankruptcy field.

Eric’s discussion focused on the legal maneuver known as the “Texas Two-Step.” He provided an overview of the applicable Texas law and its history, along with its usage by companies to address mass tort liabilities in bankruptcy and the role bankruptcy venue shopping plays to execute the strategy.

In his practice at Spencer Fane, Eric assists clients nationwide with all aspects of bankruptcy, reorganizations, negotiations, collection actions, multijurisdictional insolvencies, and corporate liquidations. He also has experience navigating complex Chapter 11 and Chapter 7 bankruptcy cases.
