The National Law Review featured the legal insights of Spencer Fane attorney Eric Peterson in two of its recent receivership-focused articles.
In Navigating the Challenges of Operating and Selling a Cannabis Company in Receivership, Eric discussed the relevance of the receivership process to the evolving cannabis industry. “Distressed cannabis businesses, if they’re to undergo an insolvency-type proceeding, have to use a receivership or other state court process,” he shared.
Eric also joined other industry thought leaders for the article, Unusual Receivership Assets. “The beauty of receivership is its flexibility,” he said. “You can craft an appointment order that fits the unique facts, but that flexibility also means you need to be precise. The order is your roadmap.”
At the firm, Eric represents investors, financial institutions, business owners, debtors, creditor committees, receivers, bankruptcy trustees and other fiduciaries, and large and small companies in maximizing the value of business assets, achieving operational turnarounds, and going concern sales, among other matters. He is also the founding president of the Commercial Receivers Association, which has quickly grown to an industry-leading organization serving the needs of receivership professionals.
