Cody Faulk Returns to UT Law Land Use Conference to Discuss Utility Industry Trends

For the second year, Spencer Fane attorney Cody Faulk presented at the annual Land Use Conference. The UT Law CLE-hosted event took place April 4-5 in Austin.

This event offers high-level, detailed coverage of the key issues, strategies, challenges, tools, and opportunities facing municipalities, counties, and developers. The conference agenda focuses on real-world problems with practical solutions presented by an outstanding faculty, including developers’ attorneys, land use planners, local government attorneys, engineers, and state and local regulators. In addition to leading a session, Cody served on the event’s Fundamentals and Conference Planning Committee.

During his presentation, Why Would Anyone Want to Own and Operate a Utility, Cody analyzed recent trends in a key Texas industry: the water and wastewater regulatory environment. He addressed what hurdles investor- and developer-owned utilities face in front of Texas regulators, navigating municipal oversight and relationships, and the financial and business outcomes from regulation.

At Spencer Fane, Cody co-leads the firm’s Utilities team. He represents investor and municipally owned utility clients in both routine and complicated administrative, transactional, operational, and regulatory issues, helping them capitalize on financial benefits in operations while avoiding potential crises. He specifically focuses on regulatory and enforcement proceedings for municipalities, utilities, and landowners before the Public Utility Commission of Texas, Railroad Commission of Texas, Texas Commission on Environmental Quality (TCEQ), and the State Office of Administrative Hearings.
