Brian Peterson Gives Insight Into the NLRB’s Plans for Stricter Remedies for Unfair Labor Practice Violations

Spencer Fane attorney Brian Peterson recently wrote an article featured in BenefitsPRO summarizing a newly issued memorandum on unfair labor practices published by the Office of the General Counsel to the National Labor Relations Board (NLRB).

Titled “NLRB encourages regional offices to pursue alternative make-whole remedies,” the article discusses Memorandum (GC 21-06) which was issued to all Regional Directors, Officers-in-Charge, and Resident Officers. The notice outlines that any victims of unfair labor practices should be eligible to receive remedies for their losses resulting from unlawful conduct.

Brian covers what employers should know about this recent development, noting that “[i]f the Board finds that an employer has committed an unfair labor practice then it must issue an order requiring the employer to cease and desist from the identified unfair labor practice.”
