Spencer Fane attorney Andrew Brought recently spoke with Business Insurance reporter Louise Esola about the Occupational Safety and Health Administration (OSHA)’s shift in priorities now that the administration has “declared the pandemic [is] over.”
The article, Safety Regulators Expected to Widen Scope as COVID Concerns Wane, appeared in the publication’s January 2023 issue. In it, Drew offered his perspective on OSHA’s increasing attention toward heat illness and prevention and repeat offenders.
“OSHA was pulled in multiple directions in 2022,” Drew said. “[They] never got around to issuing a heat-hazard proposed rule … but did issue an enforcement emphasis program for heat hazards that appears to have had marginal results.” Drew also noted that OSHA has been “very focused on repeat offenders and really ratcheted up inspection and penalties on employers with prior citations.”
