A.J. Ferate and Andy Lester Analyze McGirt v. Oklahoma

Spencer Fane attorneys A.J. Ferate and Andy Lester recently presented a teleforum for The Federalist Society on the recent Supreme Court ruling concerning tribal law.

As part of the recurring series “Courthouse Steps Decision,” A.J., Andy, and co-presenter University of Oklahoma College of Law Professor Taiawagi “Tai” Helton explored the ruling in McGirt v. Oklahoma and its implications moving forward. The case bars state authorities from prosecuting major crimes committed by Native Americans on the Creek reservation, which the Court held includes much of the City of Tulsa. The ramifications of the ruling appear to go far beyond the strict holding of the Court’s 5-4 majority.
