Joined by Greenberg Traurig’s Jennifer Weddle, A.J. analyzed the Supreme Court’s recent finding that the United States is not responsible to take affirmative steps to secure water for the Navajo Nation. The pair provided historical context for the decision, examined details and key viewpoints of the case, and answered attendee questions.
Speaking to the impact this case will have on other trust relationships between tribes and the U.S. government, A.J. noted the Supreme Court’s desire to evaluate on a treaty-by-treaty basis. “The court has said ‘we want to see … what’s actually in the treaty and what is the basis of your statement that the U.S. owes you a particular thing or not?’” he said. “And beyond that, we encourage you to go to Congress and ask for that.”
