Following the U.S. Supreme Court’s Trump v. Slaughter decision, regulatory priorities at independent federal agencies are expected to shift more rapidly with changes in presidential administrations, creating a “ping pong” effect that counterintuitively can increase compliance burdens due to the need to plan for less predictable outcomes.

Mike said the Slaughter decision is likely to remove agencies’ incentives to “engage with stakeholders from all sides.” There’s a further risk, he added, of agencies becoming “echo chambers” under every successive presidential administration, as well as losing the “institutional prerogative to maintain at least a patina of harmony.”
