Spencer Fane attorneys Mark Rooney, Yana Rusovski, and Mike G. Silver are featured speakers at the upcoming Mortgage Bankers Association’s (MBA) Legal Issues and Regulatory Compliance Conference taking place from May 4-7, at the Intercontinental Miami. Spencer Fane is a gold sponsor for the event.
The four-day conference will gather legal and compliance leaders to deliver critical updates on recent legislation, cases, and trends impacting the real estate finance industry while also offering predictions and strategic advice for long-term success.
More than 15 attorneys from the firm’s Mortgage Banking Litigation and Regulatory Market Team will be in attendance, with the team’s compliance section notably co-led by Yana and Mike. The market team members represent a wide variety of clients across the mortgage and real estate industry, including mortgage lenders and servicers, mortgage brokers, banks and credit unions, homebuilders, real estate brokerage firms, property management companies, FinTech companies, and lead generators.
Mark’s session is a part of the conference’s “Litigation Forum Track,” while Yana’s and Mike’s sessions are within the “Applied Compliance Track.”
On Monday, May 4, Mark will speak at “Fair Lending and RESPA,” where he and fellow panelists will highlight recent fair lending and Real Estate Settlement Procedures Act (RESPA) cases and litigation.
On Tuesday, Yana will present her insights at “Chatbot Chatter – Managing Fair Housing and ECOA Risks in AI Driven Lending,” a highly topical conversation that will examine how artificial intelligence (AI) chatbots and agents can create disparate treatment and impact risk, then will conclude the session with a discussion of evaluation practices and risk management techniques.
Also on Tuesday, Mike will present a session titled, “RESPA Section 8.” Mike and fellow panelists will dissect the most pertinent issues, best practices, and tips to mitigate risk associated with RESPA Section 8, including recent enforcement actions.
At the firm, Mark represents consumer finance companies facing complex litigation and arbitration, combining trusted counsel with fierce advocacy to resolve some of the most contentious disputes. He also regularly helps clients respond to government agency investigations and enforcement actions.
Yana focuses on regulatory compliance, preventive counseling, and defending against enforcement actions, informed by her prior leadership experience at the U.S. Department of Housing and Urban Development. She regularly helps clients identify and manage fair housing and fair lending risks and specializes in developing carefully tailored strategies to resolve disputes in ways that safeguard business goals, reputations, and relationships.
Drawing on more than two decades of private and public sector experience in the nation’s capital – including a 12-year stint at the Consumer Financial Protection Bureau, where he wrote several mortgage regulations and policy guidance documents – Mike counsels mortgage lenders, banks, FinTech companies, and other mortgage industry and financial services clients on regulatory compliance, product counseling, and policy advocacy.
