Troy Rackham Discusses His Colorado Supreme Court Trial Win with Law360

Spencer Fane attorney Troy Rackham was recently quoted in a Law360 article detailing the Colorado Supreme Court’s decision in Johnson Family Law v. Bursek, a case in which Troy successfully defended an attorney against an unreasonable contract provision.

The piece, Colo. Justices Say Firm’s Departing Atty Fee is Unenforceable, explains the court’s unanimous decision that a contract requiring a departing attorney to pay a fee for every client who elects continued representation by the departing attorney “improperly limits the attorney’s practice.” Troy also expressed his gratitude for such an outcome in the article.

“[My client] decided to challenge the unfairness of the provision … and wanted to create a precedent that firms shouldn’t be able to do this,” Troy shared.
