Spencer Fane is pleased to announce that firm Chairman Pat Whalen was recently recognized as a Cyber Security Trailblazer by The National Law Journal for his accomplishments on behalf of clients in this emerging area of law.
While cyber security issues have dominated national headlines in recent years, Whalen’s experience counseling clients on these issues dates back nearly two decades. His initial involvement traces back to one of the first cases arising from an intrusion into a client’s computer network. Since that time, Whalen has aided clients, including many major financial institutions, in developing and executing both proactive and responsive data breach strategies.
Whalen routinely counsels clients on their data breach response policies as well as proactively mitigating cyber threat by identifying and addressing top risks to a company’s cybersecurity. He also regularly prosecutes claims against insiders who have breached their employers’ networks and safeguarding systems. Whalen and his colleagues help ensure companies are in compliance with all relevant legal requirements, create protocols surrounding how to respond when a data breach occurs and litigate potential lawsuits regarding data breaches.
Whalen has not only made cybersecurity the focus of his personal practice, but he has been a strong voice in the industry, as it relates to the immediate need to adopt proactive policies and procedures for anticipating and responding to breaches. He is regularly sought out for his knowledge on the subject of data security and data breach protocol. Most recently, Whalen published an article in BankNews titled, “When to Send a Data Breach Notification.” He has also given numerous presentations on cyber liability, crime and sabotage for esteemed organizations including the Association of Corporate Counsel. Additionally, he is a current and longtime member of the American Bar Association’s Cyberspace committee.
