Governor Greitens Orders Review of Every Missouri Regulation

On January 10, 2017, Missouri Governor Eric Greitens signed Executive Order 17-03 (the “Order”). Among other things, the Order compels all state agencies to review each and every Missouri regulation appearing in the Code of State Regulations that falls within their jurisdiction. Absent contrary action by the Governor, the reviews must be completed on or by May 31, 2018, and include a 60-day period for receipt of comments by interested individuals and businesses. Following the review, agencies must certify that the regulations either do or do not meet certain requirements, including that: (a) the regulations are “essential to the health, safety or welfare of Missouri residents,” (b) the benefits of the regulations outweigh their costs, and (c) the regulations do “not unduly and adversely affect Missouri citizens or customers of the State, or the competitive environment in Missouri.”

In addition to compelling review of existing regulations, the Order also suspends all agency rulemaking until February 28, 2017.

The Order affords individuals and businesses affected by state regulations the opportunity to be heard in respect of those regulations. Those affected should take note.
