The United States Environmental Protection Agency, Department of Justice, and state environmental agencies are taking increasingly aggressive positions to enforce environmental laws through rigorous inspections, more stringent regulatory interpretations, fines, and penalties, including criminal charges. EPA has published national enforcement initiatives, and the EPA regional offices and the states have added their own enforcement priorities.
This presentation reviews recent federal and state enforcement activities and priorities to help the regulated community better plan for environmental compliance and agency inspections. It reviews enforcement initiatives under the major regulatory programs such as hazardous waste, air, wastewater, risk management, accident prevention, and reporting. The presentation identifies several industries that have been targeted for recent inspections and enforcement activities. It discusses preparing for and responding to agency inspections, handling an inspection, and pointers for potential settlements.
