Overview

Tyler Scott helps insurance providers evaluate novel and complex insurance coverage claims and develop risk-averse strategies to resolve issues and negotiate disputes to avoid costly litigation. When litigation becomes necessary, he employs years of experience and strong legal acumen to defend clients against breach of policy and bad faith claims and to pursue subrogation and contribution on behalf of clients in state and federal courts across the country.

Tyler navigates a wide assortment of insurance claims, including CERCLA and other environmental liability, toxic tort, construction defect, business interruption, false advertising, catastrophic loss and disasters, and sexual assault and abuse, under equally diverse policy types.

A progressive industry thought leader, Tyler also advises on new and emerging insurance industry issues – such as cannabis, climate change, and PFAS contamination – then presents his findings in various legal forums.

Additionally, Tyler’s practice includes general commercial litigation, including defending manufacturers against product liability claims and litigating commercial contract disputes.

  • Successfully defended insurance company in multiple class actions across the country alleging coverage for business interruption losses allegedly arising from the COVID-19 pandemic.
  • Secured judgment confirming that insurer had no coverage obligation to insured under commercial general liability policy for false advertising and Lanham Act claims.
  • Successfully defended national manufacturer in product liability lawsuits, obtaining dismissals and summary judgments.
