Overview

Timothy P. Burr represents buyers, sellers, developers, investors, lenders, and business owners in a wide variety of real estate, financing, and commercial transactions, developing strategic plans based on a meticulous evaluation of risks and advantages. Well versed in alternative dispute resolution, he also represents clients as a mediator, arbitrator, and mediation advocate.

In addition to representing buyers and sellers in transactions of all sizes and levels of complexity, Timothy’s extensive experience includes negotiating and drafting commercial and residential leases; reviewing loan transactions, deeds of trust, and other financing documents; representing developers and members in the construction and operation of golf courses and golf communities; and assisting in the development and leasing of wireless communication sites throughout Arizona and the Southwest.

Notably, Timothy was the author of a petition to the Arizona Supreme Court and architect of the campaign that resulted in the subsequent adoption by the Court of an admission on motion rule for Arizona, which permits experienced Arizona attorneys to gain access to admission in other reciprocal states without taking another bar exam. Following the rule change, Timothy was appointed by the Court to serve on the Admission on Motion Task Force.

Timothy was a faculty member at Arizona State University College of Law and served as the director of the Foreclosure Mediation Unit (FMU), which provided impartial mediation services between lenders and residential borrowers facing foreclosure through a court-connected program with the U.S. Bankruptcy Court for the District of Arizona. Timothy designed the FMU program rules, procedures, and forms and then used that framework to develop and lead the academic component.

  • Counseled several homeowners associations on all aspects of the law pertaining to community associations, including drafting, amending, and interpreting declarations of covenants, conditions and restrictions, bylaws, rules and regulations, architectural guidelines, and other governing documents; covenant and rule enforcement; and other legal issues.
  • Served as a member of the American Arbitration Association Commercial Mediation and Commercial Arbitration Panels.

  • Served as an arbitrator on the State Bar of Arizona Legal Fee Arbitration Panel.
