Corporations conduct internal investigations when confronted with a significant potential liability that management does not fully understand. The investigation determines whether alleged conduct actually occurred, the responsible parties and any appropriate corrective action. The internal investigation in response to a threat of government enforcement presents unique issues regarding potential individual liability for employees and the company’s cooperation with the government. All internal investigations present business issues that must be addressed early – from confidentiality to disclosure to potential conflicts of interest. The program will discuss the key elements of a deliberate plan of response and decision making, including effective and protected investigations, strategic communications, and management of dual investigations – with suggestions to assist in internal investigations.
