Daniel J. Burke
Overview
Dan Burke provides proactive, solutions-oriented counsel to a wide variety of real estate clients – including regional and national companies, public and private institutions, developers, and lenders – for all stages of real estate transactions, employing a multidisciplinary approach rooted in a diverse track record of successful outcomes.
In addition to effectively helping clients navigate the purchase, sale, leasing, financing, and development of real estate, Dan also guides clients through the site selection and project approval process, including helping obtain planning and zoning approvals. When negotiating leases, he tailors efforts to material client concerns to streamline resolutions while protecting client interests. On the development side, he serves as a robust, detail-oriented representative for tax increment financing, Missouri’s Chapter 100 industrial revenue bonds, transportation development district (TDD) and community improvement district (CID) financing, Chapter 353 tax abatement, and other related incentives.
Dan’s practice also includes negotiating and facilitating favorable results through workouts, restructurings, receiverships, liquidation, and, when necessary, foreclosure and deficiency pursuit.

- Serves as primary real estate counsel for major health care system handling both routine acquisitions/sales and complex development and real estate issues.
- Structured and gained approvals for a complex, multi-phase redevelopment project supported in part by tax increment financing. After five years, over $600 million was invested in construction, creating 5,000 jobs and completely transforming a 167-acre area of St. Louis.
- Represented long-time real estate development client in acquisition of office building in Clayton, Missouri, including lease diligence.
- Served as incentives and zoning counsel for redevelopment of former hospital site in Frontenac, Missouri.
- Negotiated all leases for multi-year expansion of major retail franchisee across multiple states.
- Completed a $55 million sale of an advertising company to a public company. The asset sale transaction involved the sale of rights in over 400 locations in four states, the transfer of over 1,000 advertising contracts, and the sale of two commercial buildings. Dan helped the client navigate various real estate issues and achieve its goal of selling the business.
- Represented a St. Louis regional beer distributor in the purchase and development of new headquarters facility, including incentives components.
- Counseled a mining company through the rare sale of a federal Superfund site, an 1,800-acre former cobalt mine. This included securing a collateralized walk-away indemnity for the client, handling the real estate components, and assisting with the relationship with another responsible party for the cleanup during the transaction.
- Handled acquisition, diligence, and incentives for successful redevelopment of blighted property to expand manufacturing capacity in Hazelwood, Missouri.
