Since before the enactment of COBRA, the Spencer Fane Employee Benefits Practice Team has helped health plan sponsors and administrators comply with the increasing array of federal laws affecting their plans. Today, that means advising them on the twists and turns of regulatory changes. We work with employers, third-party administrators, and insurers to explain the requirements in this area – including opportunities the laws have created.
We help employers with all of the issues they face under the Affordable Care Act. This includes navigating the “play-or-pay” decision; consulting on ACA-related compliance issues; drafting required plan amendments, communication materials, and notices; and providing summaries, checklists, flow charts, and other tools for use in developing an overall health care strategy. We also counsel larger employers on the technical rules governing ACA reporting (using IRS Forms 1095-C and 1094-C).
