Matthew Dalton Explains Advantages of Special Districts Over HOAs in Denver Business Journal Interview

Spencer Fane attorney Matthew Dalton was recently interviewed by the Denver Business Journal in an article detailing the attempts to make housing in Denver more affordable by utilizing special districts.

Titled “Could replacing HOAs with special districts help Denver’s housing affordability?” the article outlines the reasons some housing developments have chosen to be run by special districts instead of homeowners associations (HOAs).

“The fact that taxes are collected also means that the homeowner should be able to deduct the cost of services on his or her federal income tax return, rather than paying nondeductible HOA dues,” Matthew said. “The homeowner may pay the same dollars to the district through taxes, but the actual out-of-pocket cost is approximately 30 percent less.”
