Erick Robinson Quoted in Bloomberg Law’s Texas Patent Case Assignment Update

January 24, 2023

Spencer Fane attorney Erick Robinson was recently quoted in a Bloomberg Law article discussing the contentious court policy in the Western District of Texas that now randomly assigns patent cases to the District’s judges.

The article, West Texas Patent Case Assignment Order Stays in Place, for Now, describes how the policy arose in response to criticism that patent plaintiffs overwhelmingly sought Judge Alan Albright’s court. Noting that the District has a new chief judge following the retirement of Orlando L. Garcia, who issued the patent case order, the piece shared Erick’s update on the possibility that the policy will end.

“In case anyone thought Judge Garcia’s order had changed, unfortunately, no such luck,” Erick said. As he and Bloomberg observed, the only “tweak” new Chief Judge Alia Moses has made thus far is removing one of the 12 judges on the order’s list.

At Spencer Fane, Erick serves as Co-Chair of the Intellectual Property Practice Group. He manages and tries “bet-the-business” patent cases for clients from Fortune 100 companies to sole inventors. He fiercely protects his clients’ patents, trade secrets, and other intellectual property. Erick has also provided ongoing commentary on the state of the West Texas patent court.
