Spencer Fane Wins Jury Verdict for Client

Spencer Fane’s client, a moving and storage company, entered into a two-year contract with a large furniture retailer, to be the exclusive provider of home delivery services for its chain of furniture stores in the St. Louis area. After providing delivery service for a year, the furniture retailer terminated the contract, claiming a “material default” by Spencer Fane’s client.

Spencer Fane filed a lawsuit in St. Louis County Circuit Court claiming that the retailer had wrongfully terminated the contract. The retailer argued that it had justifiably terminated the contract. During a four-day jury trial, Spencer Fane attorneys successfully undermined the furniture retailer’s entire case by introducing evidence that, before ever declaring a default, the retailer had already signed another contract with our client’s competitor.

As a result of the evidence and arguments introduced at trial, the jury returned a unanimous verdict in favor of Spencer Fane’s client, awarding it the lost profits that it would have earned had the contract not been wrongfully terminated.
