Erick Robinson Explores Patent Venue Mandamus Cases in the Western District of Texas

Spencer Fane attorney Erick Robinson recently co-authored an article in Texas Lawyer on the wave of patent venue mandamus cases in the Western District of Texas.

The Federal Circuit’s 2020-2021 Patent Venue Mandamus Cases” is the first article of a four-part series covering patent litigation. Erick describes the unique factors that have resulted in a significant rise in patent filings in the district and a subsequent rise in motions to transfer and mandamus petitions. Erick and his co-authors also explain the Federal Circuit’s tendency to read requirements into patent statutes as well as analyze the fact that the Federal Circuit’s venue decisions are panel-specific.

Based in Texas, Erick is a partner and co-chair of the Intellectual Property practice at Spencer Fane. He manages and tries “bet-the-business” patent cases on both sides of the docket.
