Cynthia Rowe serves as a Spencer Fane eDiscovery Counsel and co-leads the firm’s Discovery and Data Analytics Team.  She advises clients on litigation and investigation matters and manages all aspects of the eDiscovery process to reduce legal spend while enhancing client outcomes.  She also offers advisory services to help clients unify their policies, information technology solutions, and business practices.

With over 20 years of experience as an attorney and legal business consultant, Cynthia has managed all aspects of eDiscovery ranging from small routine matters to multi-firm complex litigation and investigation matters, securing legal and strategic outcomes for her clients.  She has been involved in developing and evolving comprehensive litigation readiness plans, information governance programs, corporate policies and compliance efforts, and data privacy initiatives.  Cynthia has advised law firms and legal departments on developing eDiscovery and litigation management programs, law department and law firm strategy and operations, legal technology selection and implementation, outside counsel and vendor management, and knowledge and change management.

In addition, Cynthia advises clients on strategic initiatives, including executive leadership and organizational change, continuity planning, policy development, and risk management.

Cynthia believes in an interdisciplinary and collaborative approach to problem-solving and strives to create human-centered solutions that reduce risk and enhance business and financial objectives through the use of technology, innovative process design, and strategic planning.

Experience

  • Developed and executed litigation strategy with national merits counsel, local counsel, in-house counsel, and vendors, primarily focused on eDiscovery issues, ensuring a consistent approach to key legal and business interests across clients’ entire litigation portfolios.
  • Drafted and negotiated ESI protocols, protective orders, and discovery plans. Collaborated with merits counsel in drafting motions, briefs, and supporting affidavits on issues including burden and proportionality of discovery, sufficiency and format of productions, data spoliation, sanctions, privilege claim challenges, and claw-backs.
  • Prepared counsel for meet and confers and court hearings on eDiscovery issues. Provided eDiscovery guidance for fact witness and 30(b)(6) depositions.
  • Contributed to transformative programs for legal departments and law firms through the use of operations strategy, legal technology, process design, and cost containment. Gathered business requirements and conducted strategic technology assessments and implementations, analyzed historical legal spend, and outlined financial metrics needed to facilitate future business planning, defined and aligned roles & responsibilities, developed training programs, and facilitated change management.
  • For law firms and corporate legal departments, provided day-to-day management and strategic evaluation of outside counsel and eDiscovery partners. Created resource repositories and built collaborative workspaces for cross-functional and multi-firm legal teams.  Prepared budgets, forecasts, and financial reports for litigation matters with spending ranging from $5k to $1M+ per month.
