Cody Faulk represents investor and municipally owned utility clients in both routine and complicated administrative, transactional, operational, and regulatory issues, helping them capitalize on financial benefits in operations while avoiding potential crises. He specifically focuses on regulatory and enforcement proceedings for municipalities, utilities, and landowners before the Public Utility Commission of Texas, Railroad Commission of Texas, Texas Commission on Environmental Quality, and the State Office of Administrative Hearings, including providing consulting services to outside firms needing aid in navigating these regulatory agencies.

In addition, Cody has extensive experience representing and defending local municipality, utility, and semi-governmental entity clients in a wide range of matters including regulatory enforcement and permitting, Open Meetings Act and Public Information Act compliance, land use regulation, and litigation in Texas state courts. He regularly helps clients in cases ranging from utility rate-making proceedings, electric transmission line routing, sale/transfer/merger applications, and retail service area disputes.

Cody’s work keeps clients ahead of the curve as they efficiently grow and expand operations, using his strong relationships with municipalities and other government entities to create effective collaboration between key stakeholders that advances clients’ objectives and business interests.

A sixth-generation attorney who grew up in Brownsville, Texas, along the Rio Grande, Cody calls Austin home. When he’s not with his wife, daughter, and miniature Aussie, he can likely be found exploring the Texas Hill Country, running the trails around Austin, or rooting on Austin FC.

Highlights of Cody’s experience include:

  • Represented the first Class A water utility in Texas to file for a rate increase at the Public Utility Commission.
  • Represented a large municipally owned electric utility in its request to integrate 400MW of electric load into the Electric Reliability Council of Texas.
  • Represented municipalities, water districts, and individual landowners in transmission line routing proceedings at the Public Utility Commission.
  • Represented municipally owned utilities in disputes regarding Public Utility Commission certificated electric service areas.
