Securing and enforcing intellectual property rights for our clients is the
heart of the Life Sciences Practice. We help our clients develop intellectual
property strategies that focus on protecting both the path to market as well
as developed products at the earliest stages of technology development. Our
attorneys and scientists have decades of experience with securing IP rights
(IPR) throughout the world including in the United States, European Union, China,
India, Japan, Canada, and Mexico. Our staff members are also highly trained
in international patent and trademark procedures and have access to nearly one
hundred databases to assist our clients with searching, analyzing and implementing
due diligence strategies. In particular, our attorneys and scientists have experience
with:
- Procuring foreign and domestic patents, registered trademarks and copyrights
- Litigating patent, trademark, copyright and related matters in state, district
and appellate courts
- Counseling on the management and development of intellectual property rights,
identifying and patenting key innovations, and developing patent and trademark
portfolios, some of which have encompassed fifty countries and hundreds of
pending patent applications
- Preparing patent landscape reviews and freedom-to-operate opinions in some
of the most crowded and competitive areas of patented life sciences technologies
- Conducting due diligence related to initial public offerings, venture capital,
and other investments, mergers and acquisitions
- Preparing patent infringement and validity analysis and opinions
- Conducting patent interferences and appeals, re-examinations, reissues and
oppositions

that include scientific data and other downstream information provided by contract
research organizations (CROs) and contract manufacturing organizations (CMOs),
freedom-to-operate analysis and competitive intelligence, financial and market
information, regulatory guidance, and post-market issues such as reimbursement
and manufacturing information. By integrating this information in an intellectual
property strategy, we help our clients enhance the potential for generating
revenue streams from licenses and investors. In addition, obtaining regulatory
compliance and compliance with industry standards can be advanced by leveraging
work conducted by CROs and CMOs.
