As is so often the case, Congress took an unobjectionable goal — protecting individuals from invidious discrimination on the basis of their genetic make-up — and turned it into a nightmare for employers. The 2008 Genetic Information Nondiscrimination Act ("GINA") imposes a number of constraints on employers' actions. This is true in both the pure employment context and as sponsors of group health plans. Moreover, GINA "reshuffled the deck" on a number of other federal laws — including the ADA, FMLA, and HIPAA — thereby forcing employers to go back to school on those laws, as well. This webinar will address all of these GINA issues, but with a special emphasis on employer health plans.

Learning Objectives: Be able to identify and solve compliance issues associated with GINA.

Spencer Fane Foundation Created - Three Inaugural Recipients Selected

November 17, 2009 - Spencer Fane Britt & Browne LLP announces the formation of the Spencer Fane Foundation. Working with Greater Horizons, administered by the Greater Kansas City Community Foundation, the Spencer Fane Foundation will identify non-profit recipients for annual giving. The Foundation has selected the theme of innovation and arts for its initial focus. "This focus expands the significant commitment we made a few years ago to the Kauffman Center for the Performing Arts," said SFBB Chairman Mike Saunders. "Consistent with our core firm values, this theme enables us to balance our support of the arts community's mature organizations with support of incubator organizations. September 30, 2009 - Spencer Fane is pleased to announce the addition of Lih Chen to the Intellectual Property and Life Sciences Practices in our Kansas City office. Lih received his juris doctorate from the University of Iowa College of Law and a bachelor's degree in Chemistry with a Computer Science minor from Case Western Reserve University. He has developed software for the healthcare, education and financial industries. Lih also founded a computer consulting firm and taught courses in software, hardware and web development before attending law school. September 14, 2009 - Kevin Buckley will lead a discussion on September 30, 2009 from 7:00 to 8:15 PM as part of the Constitutional Law Lecture Series held at St. Louis Community College Florissant Valley. Kevin will speak about "Science and Commerce: Who Owns the Building Blocks of Life?" and will analyze the intellectual property and constitutional implications of a law suit the American Civil Liberties Union filed against the U.S. Patent & Trademark Office and Myriad Genetics. The law suit challenges the patentability of the BRCA1 and BRCA2 genes which are diagnostic for breast and ovarian cancers. As the leader of Spencer Fane's Life Sciences Practice, Kevin has over a decade of experience with biotechnology patent and constitutional matters. Gerald Greiman Appointed Chair of University City Civil Service Board

September 1, 2009 - The City Council of University City, Missouri, has appointed Gerald Greiman, a partner at Spencer Fane Britt & Browne LLP, St. Louis, Chair of the University City Civil Service Board. Greiman will serve a three year term on the Board, expiring in April 2012.

The five-member Civil Service Board advises the City Council and Director of Personnel on issues regarding personnel administration, hears appeals from disciplinary action, makes investigations concerning personnel administration, and approves civil service rules.

Greiman is Co-Chair of the firm's Litigation & Dispute Resolution Practice Group. He concentrates his practice in the area of complex civil litigation, at both the trial and appellate levels. Among his other civic positions, he is the current President of the St. Louis Jewish Community Relations Council, and serves on the board of directors of Planned Parenthood of the St. Louis Region and the Missouri Coalition for the Environment.

Patrick Whalen to Moderate International Law Forum

July 6, 2009 - Patrick Whalen to moderate International Law Forum on Intellectual Property (IP) and Information Technology (IT) Representations and Warranties in Cross Border Acquisition Agreements. The program, jointly sponsored by the International Law, Business Law, and Intellectual Property Law Sections of the American Bar Association, will be held on August 1, 2009 in conjunction with the ABA Annual Meetings in Chicago. A successful transfer of IP and IT rights requires a keen understanding of the nature of those property rights on the part of the deal makers so that they can undertake the necessary due diligence and put into place tailor-made comprehensive contractual provisions which address the issues and concerns arising out of the particular transaction. A last minute intervention by the IP and IT lawyers will not bridge the gap resulting from the failure to deal systematically with IP and IT issues from the very beginning of the deal making process. Dave Seitter a featured presenter at the ABA Construction Forum Annual Meeting

April 17, 2009 - Dave Seitter was a speaker at the ABA Annual Meeting in New Orleans on April 17, 2009. Dave's presentation dealt with the relationship between the Bankruptcy Code and construction law, and was intended to be a primer for use by construction law attorneys to re-familiarize themselves with the intricacies of the Bankruptcy Code. His presentation described the effects of bankruptcy actions by owners, contractors and subcontractors on project completion and payment requirements, and provided in-depth analysis of how mechanic's liens, surety bonds, jurisdictional challenges, set-off and recoupment, as well as earmarking and trust funds, are treated under the Bankruptcy Code. Dave is using his experience in bankruptcy law to navigate and position SFBB as a firm having expertise in the area of construction law. Deirdre Gallagher Awarded 2009 Women's Justice Award

March 24, 2009 - Deirdre Gallagher has been awarded the St. Louis Daily Record "Trial Practitioner's" Women's Justice Awards. Gallagher was recognized for her long-standing commitment to improving the quality of justice in the community. Gallagher is currently on the advisory board for Legal Advocates for Abused Women, the Leadership Counsel for the University of Missouri St. Louis College of Nursing, and is Chair of the Pierre Laclede Society for the College of Nursing Alumnae. FDA attempts to streamline its drug pipeline with hires

August 15, 2008 - Kevin Buckley was interviewed for an article related to the Food & Drug Administration (FDA) drug application backlog. The impact of the backlog is apparent as time-to-market is increasing for all pharmaceutical and biopharmaceutical companies, as well as the cost of clinical trials increasing as the FDA becomes more stringent in analyzing safety data. The market has responded in interesting ways. For example, venture capitalists are typically funding companies later and later in the drug development process to both diminish the downside risk of early-stage investments as well as shorten the amount of time their investments are tied up in the drug development process. Contract Research Organizations (CROs) and Contract Manufacturing Organizations (CMOs) are also becoming booming as pharmaceutical companies seek to outsource clinical development work to more cost-effective resources. Patent and pharmaceutical life cycle management strategies are also changing in response the backlog as patent term extension (PTE) becomes increasingly important, especially in the United States where the PTE is shorter than most other countries.

6th Corn Utilization & Technology Conference

June 2-4, 2008 - Kevin Buckley assisted the National Corn Growers Association organize the "ABCs of Commercialization" panel where he discussed strategies for developing strong intellectual property as a platform for increasing license revenue, venture capital funding, regulatory approval, sales revenue and reaching the market more efficiently. Dr. Richard Glass, Vice President of Research & Business Development, and Nathan Fields, Director of Research & Business Development, provided expert support and the foresight to provide information on commercializing agriculture biotechnologies in the context of building an international carbohydrate-based economy. The panel moderator was Nathan Danielson, President of Biocognito, who provided a humorous introduction to each of the panelists presenting their perspectives on agriculture biotechnology patent, licensing, funding, regulatory and market strategies. Eric Lund, Commercialization Manager of the Pacific Northwest National Laboratory, provided a primer on licensing technologies from a large basic science research institution. Michael Peck, General Partner at Open Prairie Ventures, followed up by providing a detailed summary of a venture capitalist's perspective on investing in AgBio technologies. Tom Redick of Global Environmental Ethics Counsel detailed many of the pitfalls and promises of regulating agriculture biotechnologies in a global and "flat" environment. Finally, Derek Rapp, CEO of Divergence, Inc. synthesized his strategies for intellectual property protection, licensing, funding and obtaining regulatory approval for his nematode genomics technologies in order to efficiently reach market. Mr. Rapp's success as the leader of a start-up enterprise that will shortly enter the market with a novel product inspired all of us with his deep understanding of the commercialization process.

Milt Spaulding To Speak At Two Leading Drug and Medical Device Conferences

June 2, 2008 - This month, Milt Spaulding will head to New York City to present a "Novel Strategies/Tactics and Demonstration" at the 2nd Annual American Conference Institute Drug and Medical Device - On Trial conference. The conference, running June 24-25, is a "highly interactive trial skills event for leading litigators and in-house counsel." On Friday, May 2, Milt Spaulding spoke at the DRI Drug and Medical Device Seminar in New Orleans. He hosted a Diversity Luncheon and discussing "Tools for Developing a Successful Diversity Program."

April 29 to May 1, 2008 - Kevin Buckley spoke on the "Opportunities in Emerging Geographies" panel discussing the 2005 Patent Act of India, new Indian drug pricing policies, and evolving pharmaceuticals case law and current litigation in India. Related to these laws and policies, he discussed how investment opportunities in Indian pharmaceutical technologies and biotechnologies are changing as generic pharmaceutical manufacturers add innovative pharmaceutical products to their pipelines. April 15, 2008 - Kevin Buckley joined Spencer Fane Britt & Browne LLP as a partner and has established its Life Sciences Practice. Spencer Fane provides a strong platform for biotechnology commercialization including venture finance, strategic business planning, and patent litigation services. The firm also has the financial resources to work with new companies that are frequently undercapitalized. Spencer Fane is committed to supporting the commercialization model Kevin Buckley began developing in the year 2000 and fully implemented in 2006 and the Life Sciences Practice will continue to serve clients in this entrepreneurial capacity.

Valerie Tomlinson, with whom Kevin has worked for six years, joined him and will continue to handle international patent matters as an IP paralegal. Spencer Fane Adds Life Sciences to Intellectual Property Practice

Spencer Fane Britt and Browne LLP has added a life sciences component to its Intellectual Property Group with the addition of Kevin W. Buckley and Dr. Gale Starkey.

Nick Franke, Managing Partner in the St. Louis office, is excited about the addition of the Life Sciences Group, "It was important to find people who are as experienced and knowledgeable in the field as Kevin and Gale." Franke continues, "Life sciences is an emerging issue and we can now meet the needs and demands in this area."

Mr. Buckley, a biochemist and an attorney, joined the firm as a partner, and Dr. Starkey, a chemist, is the first non-attorney employed by the firm who will serve in a client-consulting capacity.

Mr. Buckley has extensive experience in patent and transactional legal issues, including technology transfer and licensing, pharmaceutical life-cycle management, institutional collaborations, and venture finance.

Mr. Buckley received his B.S. in Biochemistry from the University of California, San Diego, where he was a Research Scholar. He received his J.D. from the University of Pittsburgh where he was Editor-in-Chief of The Pittsburgh Journal of Technology Law & Policy. Kevin is a member of the St. Louis Technology Gateway and Illinois Biotechnology Industry Orginization.

Dr. Starkey will be a scientific advisor for the Intellectual Property Group focusing on patent prosecution and specializing in chemistry, pharmaceuticals, and biotechnology.

Dr. Starkey earned a B.A. in Chemistry from Illinois Wesleyan University and a Ph.D. in Organic Chemistry at Washington University in St. Louis followed by postdoctoral research in drug discovery at Monsanto. He taught chemistry at Southern Illinois University Edwardsville as well as consulted for several St. Louis area biotechnology companies. Prior to joining Spencer Fane, Dr. Starkey was a senior scientist at Apath, LLC where he developed and executed Apath's antiviral medicinal chemistry and compound-specific intellectual property strategies.

Dr. Starkey has two patents pending for the treatment of virus-related conditions.
