Employer Defeats Harassment and Retaliation Claims


In these daunting economic times, many companies are carefully monitoring their employment levels. As layoffs and terminations become more commonplace, many former employees claim discrimination and harassment. Employers and their law firms need to adopt smart strategies to minimize the cost and impact of such cases.

Recently, Spencer Fane attorneys secured a significant jury verdict in the U.S. District Court for the Western District of Missouri in a complex sexual harassment case against our client, a large supermarket chain. A former employee claimed that she was sexually harassed, and then fired in retaliation for reporting incidents of sexual harassment. Spencer Fane filed a motion for summary judgment on plaintiff ’s sexual harassment claim, and succeeded in having that claim thrown out. Spencer Fane attorneys tried the retaliation claim to a jury.

After a thorough presentation, the jury returned a verdict in favor of the supermarket chain, finding that the reason for plaintiff ’s termination was unrelated to her alleged complaints of sexual harassment.
