FINANCIAL RESTRUCTURING
Restructuring debt may take many forms - simple extensions of time for payment, adjusting interest rates, modifying financial covenants to be consistent with cash flow and replacing commercial loans with other debt instruments such as bonds or with various types of securities. Often, such restructure involves a combination of different approaches. Spencer Fane Britt & Browne, in concert with a business’s accountants and internal financial officers, will analyze the capital structure of a business and its projected performance to create a viable debt and asset structure to be used as a basis to negotiate with lenders and holders of securities and, if necessary, be proposed as part of a plan in civil or bankruptcy proceedings.
